Our services are to be used for legal purposes only. The transmission, the storage and/or the presentation of information, data and/or material which is in violation with Canadian federal, provincial or municipal laws is prohibited. This includes, but is not limited to: copyright-protected material, material that we consider dangerous or obscene, material protected by state secrecy and/or by any other status. The subscriber agrees to release us from any and all liability for damages to himself or to any other party resulting from the use of our services.

Furthermore, any site selling or promoting bulk email services is not allowed.

Examples of non-acceptable contents or links:

* Pirated software
* "Hacker" programs or files
* "Warez" sites
* IRC robots
* Copyright-protected MP3s

We shall have sole authority to judge what constitutes a violation of these clauses.

Limitations to unlimited traffic
Due to the unique resource characteristics and the large demands associated with certain types of sites, your site cannot use more than 20% of our system resources.

CGI Scripts
Each customer account comes with its own cgi-bin repertory. You are free to use the CGI scripts of your choice; however, we reserve the right to disable any CGI script that affects normal server operations.

Background Running Programs
We may allow programs to run non-stop in the background. These programs are considered on an individual basis and extra charges will apply according to the system resources used and the operational maintenance needed.

Bandwidth
If your site exceeds the bandwidth allocated in your contract, charges of CAD $2.50 per additional 1 000 MB will be added to your invoice.

IRC
IRC sites and IRC robots may not be installed on our servers.

Commercial Advertising - Email:
Our servers may not be the source, the intermediary or the destination address involved in the transmission of unsolicited advertising (spam), flames, or email bombs. Your domain may not be the source, the intermediary or the reply address in anything related to what is mentioned above. Advertising sites on other servers which contain links to domains hosted on our servers is prohibited. We regard as "spam" any mass sending of unsolicited messages by email or in Newsgroups. If we discover that you have "spammed", we will immediately cancel your domain without notice. In addition, we will impose a fine of US $100 each time this spam policy is violated. Lastly, we reserve the right to determine what constitutes a violation of this policy.

Hence, any violation will result in the immediate cancellation of services without refund.

Server Abuse:
Any attempt to cause damage to an Internet server or to a customer is prohibited.

Refusal of service:
We reserve the right to refuse or to cancel service at our discretion.

All subhosting, distribution sites, and dedicated servers must conform to our hosting policies.

The refusal to conform to these terms and conditions will result in the immediate cancellation of the customer’s account.

DISCLAIMER

You, the customer, agree to be the only person responsible for the contents published on your website. Nost Solutions Internet Inc will not be liable for any losses, expenses, attorney fees, and/or any other expenses generated by your website, its unavailability, its contents or any other cause. Nost Solutions Internet Inc will not be liable for loss of data arising from server attacks, material failures or any other cause including acts of God which could result in the loss of data on your site. You must ensure you have a backup copy of your website at all times in case restoration becomes necessary.
